Alan Miller, sentenced to die for a 1999 workplace shooting, says he requested to be executed by nitrogen hypoxia but that the state lost his paperwork request.
The state said it could carry out a death sentence with nitrogen hypoxia as soon as next week. Inmate Alan Eugene Miller is set to be executed on Sept. 22.
